Prenuptial and Postnuptial Agreement Solicitors
Expert legal support to protect assets and give you peace of mind.
Couples are increasingly opting to draw up a prenuptial or postnuptial agreement to clarify what will happen to assets and finances in the event of a divorce.
Our family law solicitors can give practical legal advice on preparing these agreements and draft them for you. We will ensure that you have considered all your circumstances and assets, giving you peace of mind for the future.
If you are entering a civil partnership, you can set up a similar agreement known as a ‘pre-registration agreement’. Contact our civil partnership solicitors for more information.
If you are living together and not yet ready to get engaged, you can set up a cohabitation agreement to set out what happens if your relationship ends.
Why get a prenuptial or postnuptial agreement?
Many people feel that these agreements can help couples to avoid additional conflict and stress if the relationship breaks down.
They can also be particularly useful if you want to safeguard assets which have been inherited or that you want to pass on to children from a previous relationship.
Although not yet binding on courts in the UK, they will be taken into account by the courts during a divorce and the terms will often be upheld.
Prenuptial agreements (‘prenups’)
Prenuptial agreements, commonly referred to as ‘prenups’, are used if they are set up before the marriage takes place.
Although many people think they are only used by the very rich and famous, they can be used by anyone getting married.
They are becoming more common in England, particularly for couples entering into second marriages or where the couple have unequal levels of wealth.
Prenups can be particularly useful if you have inherited wealth or business interests that you wish to protect, including in family businesses or where you may have assets or property abroad.

Postnuptial agreements (‘postnups’)
Postnuptial agreements, or ‘postnups’, are less well known than prenups but they work in the same way. They are used if the couple are already married.
Postnups can be particularly useful if, after the marriage, one partner comes into wealth or assets, such as an inheritance from a relative.
They can also be used if a couple have temporarily separated and want to reconcile. The agreement can help you both to avoid conflict in future.
